The Florida Collaborative Law Process Act (the “Act”) was signed into law by the Governor and will take effect 30 days after the Florida Supreme Court adopts rules, procedures and professional responsibility consistent with the Act.
Jeffrey P. Wasserman is on the cutting edge of collaborative law and chairs the firm’s Collaborative Law practice group.
The purpose of the Act is to allow for the negotiation of settlements in divorce and paternity cases without the use of the courts to resolve the differences of the parties. The collaborative law process creates a teamwork approach where everyone has a seat at the table to provide their input in fashioning a resolution. Each party is represented by counsel and there is a facilitator (a trained mental health professional) appointed to move the process along in a positive fashion. To the extent that neutral financial professionals are needed, they also join the team.
Now that the Act has been passed, the collaborative law process is expected to become more widely used to avoid costly and contentious litigation. Notably, under the Act the collaborative law process can be used for other types of matters outside of the family law setting.
Mr. Wasserman has already completed multiple rounds of training as a collaborative lawyer, which helps attorneys focus on the methods used to achieve a positive result. He will be attending the annual Florida Academy of Collaborative Professionals Convention in May of 2016 to continue his training and expand his practice towards more collaborative cases.
