On February 23, 2017, Florida’s Fourth District Court of Appeal affirmed an order enforcing a mediated settlement agreement, which was executed by the wife of an incapacitated business owner under a durable power of attorney. The wife sought to “undo” the agreement on grounds that she lacked the requisite authority to enter into the agreement pursuant to Florida’s Guardianship Statutes where a guardianship proceeding was pending. At the trial court level, the attorneys at Shapiro, Blasi, Wasserman & Hermann successfully enforced the settlement agreement. When the wife appealed that ruling, the Fourth District Court of Appeal per curiam affirmed the trial court’s order. This is a significant victory for the firm’s client.
